Holly Acres Lawyers File for Injunction

Document asks that the creek be maintained while the case awaits trial

Lawyers for Holly Acres Mobile Home Park owner Henry Ridge have filed an injunction with the Prince William County circuit court while awaiting trial.

The injunction asks that the park owner be able to “freely use its property pending trial, and to require that the County maintain Marumsco Creek in a safe fashion pending trial.”

“HAMP has alleged that the failure to issue electrical and building permits to repair or replace the mobile home units, and the misapplication of the regulations, amount to an uncompensated taking,” reads the document.

The document further says that due to a dry winter homes that remain on the Holly Acres property face “ongoing immediate and irreparable harm” from impending spring weather. “The longer the units sit, the more likely damage will occur.”

The injunction also says that restoring Holly Acres would come at no harm to the county. The county has previously said that rebuilding in Holly Acres would jeopardize the county’s standing in the Ridge’s lawyers allege in the injunction that it is a “complete misstatement by the county.”

The injunction trial is set for March 23.
